Owning a Property in Cambodia

Cambodia is fast becoming one of the most attractive locations for real estate investment in South East Asia. There are multiple options for foreign ownership, as a potential investor it is important to understand which best suits your interests before deciding where and how you will spend your money.

Foreigners can buy property outright in Cambodia, but there are certain conditions to be aware of. For instance, as a foreign investor you may only buy a property which is located on the first floor or above. This ‘condominium law’, or ‘strata law’ as it is known in some countries, also states that foreign ownership must not exceed 70% of the building of which must hold a ‘strata’ title.  

There are of course provisions for co-ownership of land and ground floor buildings, but only through partnership with a majority-Cambodian-owned legal entity, or a Cambodian national. As a foreign national you would be permitted to own up to 49% of any land or property through such a partnership.

To purchase property or land in Cambodia all you need is a passport and a valid visa. It is also advised that you use a lawyer or real estate agent to advise you through the process. They will guide you through performing title searches on the property to find who holds the title, or details of any registered mortgages or encumbrances.
